The draft bill Grasso, just out of the Senate Judiciary Committee and landed in the courtroom, he forfeited an amendment that extends substantially the competence of the Anti-Corruption: its offices, in fact, begin to supervise even on defense contracts, telecommunications, transport, energy, water and sponsorships. The so-called excluded sectors entering the orbit so that the Anac, therefore, takes charge of public procurement in their entirety, going to invade the prerogatives of other authorities, such as transport or energy.
The calendar of the bill
It is said that the amendment goes through. The bill has just arrived to the classroom of the Senate, after the Judiciary Committee ended a phase of work very troubled. The text, in fact, was filed on March 15, 2013 and only now preparing for the final grade; the events of recent days, however, could give him a boost. From next Monday, with the deadline for submitting amendments, the discussion in the Senate will come alive.
The defense contracts
Meanwhile, the committee passed an amendment that could have serious effects on the balance of power in the field of supervision and control, making the Anac a super independent authority, a step above all others. Article 8a of the new bill, in fact, increased the powers of the Authority led by Raffaele Cantone beyond the traditional boundaries of the Procurement Code. There are, in fact, a series of contracts which were outside its control. In the list approved by the senators appear, first of all, the contracts kept secret in the defense sector. This is an area with its own rules but rather limited impact.

Ben wider is, however, the enlargement of powers of the same amendment in other sectors. The Anti-Corruption Authority, in fact, takes charge of the supervision and control, “in order to prevent corruption phenomena,” in all sectors so-called “excluded”: in addition to sponsorships, there are contracts of energy, as the telecoms , water and everything related to the local public transport. The intent of Parliament is, of course, to complement traditional supervision of individual sector authorities that Anac, specializing in the field of public contracts.
New Skills for Canton
It is not the only innovation that broadens the range of Canton. According to another modification, in fact, prosecutors will have to inform the President ANAC, giving news of imputation, when exercising the prosecution for the offenses of extortion, corruption in its various forms, and illicit traffic of influences bid rigging. In this way, the administrative supervision can get going when the judiciary is still maintaining its findings. For the crimes of embezzlement, bribery and corruption is also excluded the plea agreement in the absence of full repayment of the price or profit of the crime. Finally, in the same vein, the Authority, in all disputes related to jobs and public contracts, will receive any relevant information or news emerged during the proceedings “that, even in response to a summary evaluation, would highlight conducted or acts contrary to the rules of transparency. ”
