Courts and Courts of and # 39; appeal, the way the new wave of cuts: a risk even Lecce – Quotidiano di Puglia

Vietti commission appointed by the Ministry of Justice to study the reorganization delel judicial branches has finished its work. The study will shortly turn into a bill that provides for the reduction of the number of courts of appeal based on workload and population tend to arrive in districts with at least one million inhabitants, a further cut of the courts, territorial rationalization of Attorney general’s office. As you know – and as confirmed in the report of the Committee – is also risk Lecce and then the detached section of Taranto, whose fate, however, appear poised for some time.

In the shuffle it is also envisaged the establishment of a task force of judges who can also operate in most judicial offices simultaneously. Moves along these lines the hypotheses of reform of the judicial geography that the ministerial committee headed by Michele Vietti, former vice president of CSM, has come up with a proposal for a bill delegation. The closure of the Committee is scheduled for March 31. The implementation of the delegation will be the second phase of the review of judicial geography after that on the courts in 2012. It is difficult, however, to proceed immediately, in local elections the cut of the courts is not popular subject. More likely that this rationalization, more considered necessary parts, is taking in hand in the coming months, after a confrontation with the territories also requested by interested categories: Anm, Bar Council (CNF), unified Body of advocacy (OAU). Also because, on paper, it is expected a nice bicycle kick which touch ‘more’ the South that the North. Tying the Court of Appeal in a pool of at least one million inhabitants, would jump and would be subject to mergers with more ‘or less neighboring offices appellate courts of power, Campobasso, Perugia, Reggio Calabria, Caltanissetta, Messina, Italy, Bolzano, Trieste, Sassari. Also at risk Lecce.

From the cuts would save Lombardy, Tuscany, Emilia Romagna, Marche, Abruzzo and Campania. Of course not all situations can equate to criminal presence and extent of the territories concerned. Hence the importance of a comparison with those on the ground. But the list is substantial. Moreover, as evidenced by the drafts of the report of the Vietti Commission, in many cases, these are real micro-districts, like Caltanissetta and Campobasso, they do not reach the 500 thousand inhabitants while 7 others have little more ‘and get to Perugia 884mila. Currently 26 of the Courts of Appeal and three operating units, only 6 districts exceed 4 million inhabitants (Milan, Rome, Venice, Naples, Turin and Bologna.)

This floor is flanked by a new intervention on the courts of first instance which aims to overcome the logic of “intangible courts”, as stated in the Commission documents.
