The law on cyberbullying: a “prof-sheriff” in the schools and the images obscured on the web – Corriere della Sera

The reviews range from “very positive” to “rebuke the legislative”. The one approved Tuesday in the Chamber is a law ambiguous to say the least. Born to protect minors, according to some, the proposal of the law for the prevention and contrast of the phenomena of bullying and cyberbullying has been “watered down”, thus extending the scope of application also to the adults. “The law has been compromised in its efficiency, – commented the Elena Ferrara (Pd) who has subjected the text to the Senate for the first time in 2014 – we Wanted a tool that is centered on children and focused on prevention and education: a line that Europe was watching with attention, giving positive reviews about the alliance in Italy is able to create with companies and the social network.” And instead? “And instead what came out is a measure with punitive and judgmental, that when the text returns to the Senate, will be put under a great lens”. Even an association like Save the Children, has worked for years for the protection and welfare of the child argues that, because the law does not remain at the castle of good intentions, will have to focus mainly on enforcement actions and education of our youngest users. “The phenomenon of bullying and cyberbullying is by its very connotation, mainly linked to young people, and in particular to the group of “equal”, and the approach with which to face it is of a primarily educational and preventive,” said Fosca Nomis, Responsible for Advocacy in Italy and in Europe of the organization. And instead of the text, modified in several points and on several occasions, although always oriented to the defense of minors, has taken on a general cutting: you can have as a victim, who is not young, and punishes both the bully digital the game the old-fashioned way.

The rules

as Amended in Committee in the Chamber, the draft law was approved by 242 votes in favour, 73 votes against and 48 abstentions. Now, go back to the Senate in third reading for final approval. But, in the meantime, fixed a few post. Starting from the definitions, timely, and fresh. Says that what are bullying (“aggression or harassment repeated harm of a victim can provoke them anxious, isolated or emarginarla through harassment, pressure, physical violence or psychological threats or blackmail, theft, or damage to, abuse or ridicule”), and cyberbullying (the same acts made with computer tools). Provides an opportunity for victims of cyberbullying to seek the removal or obscuring of the content disseminated in the network (with limitations on the recipient of the request: access providers, search engines, or sites with registered office abroad). And provides that, in case of inaction of the manager, the Guarantor for the protection of personal data you may provide directly to you.

Teacher

A substantial chapter, art. 4, is dedicated to the schools: it is introduced the figure of the “lecturer” anti-bully”: a referent for the boys, who will do the training, check, repress. A sort of sheriff, in other words. But it can also guide young people to a responsible use of the Web and to activate networks of peer education. While the principal shall “immediately inform the families of the children involved in bullying and, if necessary, convene interested parties, adopt measures of assistance to victims and penalties and paths rieducativi for the author”. A forecast is financed with an allocation of 50 thousand euros per year. In addition to the funds provided for the training of the teachers (40 million euro) and to the projects already existing in the implementation of the law 107 (the Good School), which provides the objectives for the education in digital citizenship and the responsible use of the network. A million euros have been spent only last year. “It is necessary, however, that interventions may become structural,” said the senator Ferrara.

responsible Use

The Miur, which has already issued in April 2015 Guidelines for the prevention and contrast bullying and cyberbullying will be able to implement them “also with the collaboration of the postal Police”. While it will be the responsibility of individual institutions to educate young users about the legality and the conscious use of the Internet, also in collaboration with the local associations, acting as “promoters of a path of digital citizenship in an attempt to reach all of the families,” explains Ferrara.

Obscure the web

There are those who welcomes the approval (not yet final) rules: associations that for many years in charge of the theme, in the head telefono Azzurro, which promotes training sessions and awareness-raising in schools, in the contexts of sports and of the aggregation of the guys; and political (“It fills a void on a topic is complex and delicate,” said Vanna Iori, the site of Pd. And Cosimo Maria Ferri, secretary of the ministry of Justice defines the rules that are “new to our legal system. They have the merit of addressing a phenomenon that, as it shows us the chronicle also recently assumed areas of concern”). But there is also who supports that has won the party of those who want to give the Internet a lesson: the law gives in fact the possibility of obscuring the contents of the network not only to minors but to all citizens and promises fines of up to 180,000 euros, even in cases not relevant under criminal law but which can cause concern in the navigation of the web.

platform

in the Meantime, focus on prevention and sharing of best practices the most advanced projects. The one promoted by a network of four european countries, and led in Italy by the Digital World Foundation, has led to the creation of certification paths for teachers, and to the emergence of policies on the prevention of bullying and cyberbullying at school. With the aim of curbing the silent epidemic (more than 50% of adolescents between 11 and 17 years is a victim of cyber bullying, which occur mainly at school) and train in Europe, the community school who are experts in the topic of prevention and contrast the phenomenon, four partners from Greece, Belgium, Italy and Ireland have launched the project “the Sonet-Bull” implemented within the framework of the programme Erasmus+. A project that provides a network of teaching materials and case studies, shared through the platform www.sonetbull.eu.
